Jakarta Governor Renews the Procedures and Requirements for Nuisance Permits

On 10 Sept 2013, the Governor of Jakarta Special Region (“Governor”) has issued Governor Regulation No. 101 of 2013 on Guidelines for Issuing Business Premise Licenses Based on the Nuisance Law (“Regulation”). This regulation sets out the procedures and requirements for businesses to acquire the obligatory Nuisance Permit (Izin Gangguan) for their business activities. The Regulation is of relevance to businesses in general. In general, businesses listed in Annex I of the Regulation must secure a Nuisance Permit and re-register every three years. Previously, re-registration was every five years. Further, Nuisance Permit holders are required to file an application when undergoing a transfer of ownership or brand change, or intending to expand their business premises. Nuisance Permits holders that violate the obligations set out in Article 29 of the Regulation may be subject to the following administrative sanctions (Art. 30, Regulation): 1. Written warnings 2. Temporary suspension of business activities 3. Revocation of Nuisance Permit 4. Administrative fines; and/ or 5. Sealing of business premises.
