Another one of the four implementing regulations of Law No. 4 of 2009 on Mineral and Coal Mining ('Mining Law') was reported to have been recently signed by the President and will very soon be released by the government. This time, the issued implementing regulation relates to the guidance and supervision of mining business practices.
This is according to the statement of the Head of the Law and Public Relations Bureau of the Ministry of Energy and Mineral Resources, Sutisna Prawira, made in Jakarta on Monday (26/7). Government Regulation No.55 of 2010 on Mining Guidance and Supervision, according to Mr. Prawira, “the Government Regulation has been signed by President [Susilo Bambang Yudhoyono] and is now at the [State Secretariat]”, as cited from local media.
Details of the provisions that are addressed by the Government Regulation, however, are not yet available to public, nor were they provided by Mr. Prawira. What is clear is that Government Regulation No.55 of 2010 facilitates the implementation of Article 144 of the Mining Law, which mandates further provisions on the standards and procedures for guidance and supervision of mining businesses.
Government Regulation No. 55 of 2010 is the third implementing regulation of the Mining Law that the government has issued, following the previous two Government Regulations that were released in February 2010, namely Government Regulation No. 22 of 2010 on Mining Zones and Government Regulation No. 23 of 2010 on Mining Business Activities.
With Government Regulation No. 55 of 2010 soon to be released, this means there will only be one more Mining Law implementing regulation left, i.e., on reclamation and post mining.
